What is Maximum Medical Improvement?

When you’re injured due to someone else’s negligence, it doesn’t just take a toll on your body. It also hits you hard in the wallet. A personal injury lawsuit can help you pay for doctor’s appointments and medication costs incurred as you recover from your injury.

One of the biggest issues that often arises in a personal injury case is that of maximum medical improvement (MMI). Maximum medical improvement refers to the point in time where your medical condition becomes stable in that it is not expected to improve further through surgeries, therapies, or medication. Just because you’ve reached maximum medical recovery doesn’t mean you’re all better. You can reach maximum medical recovery even if you’re permanently disabled or facing chronic pain.

What happens with a lawsuit when maximum medical improvement is reached?

This is a sensitive point in a personal injury case. Sometimes, there is a settlement and a lump sum payment. However, there are a lot of factors that can go into whether or not this is fair to the person who has been injured. Do they agree that their doctor has exhausted all possible treatment options? Will their physical situation get worse without continued treatment? Will they be able to return to their previous work? Are their physical abilities more limited than they were before the injury?

How can you be sure if your settlement is fair or not?

You can be sure that an insurance company or negligent party will aim to pay you as little as possible — that is in their best interest. Should you accept a lump sum, ask for a larger lump sum, or push for ongoing benefits?
Making a settlement without the guidance of a legal representative can be a huge and irreversible mistake. You will be asked to sign a release forfeiting your rights to any further claims. An experienced personal injury attorney can help you determine the best path forward at this crossroads.
